PSU-AAUP Files Grievance over termination of NTTF who does not get continuous appointment

A NTTF who has been here for 6 years had never been evaluated in their department. As such, they did not qualify to automatically convert to continuous appointment upon ratification of the CBA in April 2016 and had to apply for continuous appointment under paragraph 3 of Letter of Agreement #12.

Both the department committee and the department chair recommended against continuous appointment. 

This was the case that prompted the continued negotiation about appeal rights for NTTF who are not granted continuous appointment. PSU-AAUP and the University reached agreement to put in place the same appeal rights and request for reconsideration language for this member as exists for NTTF members who have applied for promotion, but in an expedited fashion so his review could continue.

Despite that agreement, the member was given a notice of non-renewal on January 3 stating the last day of their appointment would be June 16, 2017.

This notice violated Article 18 Section 2 (d) in that members who do not achieve continuous appointment are given one year notice of termination under this section.

The grievance was filed this week under Article 28 Division B Step One.
