Academic Professional Salary Increases
Several Academic Professionals have contacted AAUP regarding their in-range salary increases. According to Article 17, Section 2 of the contract, Academic Professionals who achieved an above satisfactory performance evaluation this spring are eligible for up to 1.5% salary increase. According to Mike Driscoll these salary increases will be implemented as scheduled. For eligible Academic Professionals, salary increases will be effective July 1, 2003. The Latest on Rehiring Non-Renewed Employees
According to Mike Driscoll, Vice Provost for Academic Personnel & Budget, deans and directors/chairs are currently making decisions regarding rehiring people who received letters of non-renewal in December 2002.

12-Month Fixed-Term
Employees If you are NOT being rehired, by May 30th you will receive a letter called “Confirmation of Notice of Intent Not to Reappoint.”

If you are being rehired, by May 30th you will receive a letter called “Notice of Contract Extension.” PSU administration’s current plans are to extend your current “Notice of Intent Not To Reappoint” from June 30, 2003 to September 30, 2003. This will, in effect, extend your current employment contract until September 30, 2003.

9-Month Fixed-Term Employees
If you are NOT being rehired, by May 30th you will receive a letter called “Confirmation of Notice of Intent Not to Reappoint.” If you are being rehired, no action will be taken at this time. Further information about your employment at PSU will be provided this summer.

The PSU-AAUP Executive Council is asking PSU-AAUP members for their thoughts about the future of PSU, in light of budget recommendations being made by the Budget & Priorities Committee appointed by President Bernstine. So that we can better articulate our members' position, we would appreciate your answers to the questions below. All responses are confidential.

Update for Non-Renewed Employees

PSU-AAUP has been receiving many inquiries from members who were non-renewed regarding rehiring for 2003-2004. This is what we know to date.

When You May Be Rehired

According to Mike Driscoll, Vice Provost for Academic Personnel & Budget, no firm decisions regarding rehiring will take place until PSU administrators know what the 2003-2004 budget will be.

The Budget & Priorities Committee, in concert with PSU administration, is in the process of making proposals for campus-wide budget cuts. Proposals will be presented in early May and public hearings will be held May 16 & May 22. Based on this input from the campus community, the Budget & Priorities Committee will be make a recommendation to President Bernstine in late May.

In early June, President Bernstine will finalize proposed budget cuts. Around the same time, PSU administration expects to have a better idea of what the PSU’s share of the state budget will look like.

Academic Professionals and others on 12-month contracts may know if they will be rehired as “early” as Mid June. According to Article 18, Section 2 of the Contract (see http://oaa.pdx.edu/documents/AAUP.pdf) Fixed term Instructional and Research faculty on 9-month contracts are required to receive “letters of offer and position descriptions at least 30 days prior to the first day of classes for the initial term of employment.” The Fall Quarter begins on September 29, 2003.

Benefits for Academic Professionals & Others on 12-month Contracts On April 3, 2003 PSU-AAUP sent a letter to Cathy LaTourette, Associate Vice President of Human Resources, requesting clarification of vacation and health benefits for 12-month fixed-term unclassified employees. We have not yet received a response from her but feel it is important that you know:

  • You are eligible to continue your health care benefit under the COBRA program.
  • You may receive payment for accrued vacation.
  • There are limits to the amount of vacation hours that you can be paid upon termination.
  • Payment of accrued vacation leave could be charged a supplemental tax rate of 27 percent.
  • If you have over 180 hours of vacation, you may forfeit vacation hours not taken before your termination.

Benefits for Instructional & Research Faculty on 9-month Contracts PSU will honor the past practice of extending health benefit coverage for all benefits-eligible 9-month employees through September 2003. After September 2003, you will be eligible to continue health benefit coverage through the COBRA program.

Please be aware that PSU will follow the same process used in previous years. The May 2003 payroll process will include triple your normal benefits deductions to cover June, August, and September 2003 benefits.

PSU-AAUP Annual Membership Meeting
All PSU-AAUP members are encouraged to attend the Annual Membership Meeting. This year’s meeting will be Tuesday, May 13, 4-6 pm, in the Lounge of the K-House (633 SW Montgomery St.).

Gary Brodowicz, President, will give the annual report of Chapter activities. Jacqueline Arante, Vice President for Collective Bargaining, will update members on key issues in our current round of contract negotiations. Dave & Tom Barrows will provide a legislative report, including the projected PSU budget and PERS legislation. Food and beverages will be provided by Madison’s Grill.

Commencement & Academic Regalia
This is a reminder that all tenured faculty members are required to attend spring commencement on June 15, 2003. If you are a member of PSU-AAUP, you are eligible for reimbursement up to $25 for commencement regalia rental. Reimbursement requests are due by October 15, 2003. The PSU-AAUP has endorsed two candidates for the Portland School Board election. Dilafruz Williams is a professor in the School of Education. She is running for a position in Zone 7. PSU-AAUP Needs Your Assistance
PSU-AAUP is currently recruiting members to assist with a variety of tasks. We need people who are interested in helping people learn about and exercise their contractual rights to serve on the Grievance Committee. We need people who are adept at organizing events and communicating contract bargaining infromation to serve on the Bargaining Support Team. Both committees require 2-4 hours per month committment. PSU-AAUP's new Chapter Coordinator, Julia Getchell, began her tenure at the beginning of January. Julia comes to us from the University of Wisconsin-Madison. She has a Ph.D. in Continuing and Vocational Education. She also brings extensive union experience. She was co-president of the TAA, the union that represents graduate employees at Wisconsin, and also a steward and activist in the CWA. PSU Faculty Gather to Discuss Budget Crisis

Portland—In response to the layoffs of hundreds of fixed-term faculty at Portland State University, the Portland State University Chapter of the American Association of University Professors (PSU-AAUP) is sponsoring two sessions for its members to discuss their concerns. The sessions are scheduled for Thursday, January 16, 2003 from 6:00 to 7:00 p.m. and Friday, January 17, 2003 from 3:30 to 4:30 p.m. in the lounge of the Koinonia House, 633 SW Montgomery, Portland.

PSU-AAUP's meetings follow PSU President Dan Bernstine's campus wide convocation where he will talk about the budget crisis facing PSU and Oregon. That meeting will take place on Thursday, January 16 at 4pm in the Smith Memorial Union Ballroom.

In December 2002, the PSU administration sent approximately 400 PSU employees notices of intent to not reappoint. In scripted letters employees were told that contracts would not be renewed when they expire June 2003. The layoffs involve non-tenure-line faculty and academic professionals in most departments, institutes, and offices on campus. The notices were sent to instructional faculty, research faculty, and academic professionals--essentially all PSU-AAUP represented faculty who are employed at least half-time, with a fixed-term, renewable appointment. PSU-AAUP, the union that represents the faculty at PSU, is concerned about the impact that layoffs will have on PSU students as well as its members.

November 25, 2002—Update on Article 18 Fixed-Term Faculty Reviews

Dear PSU Faculty Member:

The Association has received a number of questions regarding the sample guidelines for review of fixed-term faculty that were sent out by OAA. These guidelines are *sample* guidelines only--they are not part of Article 18, as negotiated by the AAUP and the Administration. It is the Associations' position that these guidelines are to be understood as one possible model for how a department/unit could address reviews. Departments/units do have the right to develop review guidelines that are more in line with department/unit culture.

The review process included in Article 18, Sec. 3, Reviews of Fixed-Term Instructional and Research Faculty allows a great deal of departmental/unit autonomy in the design and implementation of the reviews. There are a few important components of the review that are contractually mandated. These include:

  • The identification of a departmental/unit committee to serve as the review committee. This committee must include a fixed-term faculty member.
  • Reviews must be based on job duties outlined in the position description.
  • Departmental chairs/unit supervisors should not serve on the review committees.
  • Reviews must be completed by March 15.

Article 18, Sec. 3, also includes a list of suggested evidence to be included in the reviews. What evidence is required and how the committee reviews this evidence has been left up to the departments/units to determine vis a vis their guidelines.

At the bargaining table, the University maintained the position that, due to the University's need for "fiscal flexibility," these reviews could not be connected to rehire and/or other forms of job security for fixed-term faculty. Because these reviews only offer "eligibility for consideration for multi-year appointments" as a reward, they are to be developmental in nature and not burdensome to either the department or those under review.

For a fuller understanding of the contractually mandated components of fixed-term instructional and research faculty reviews, we urge all faculty to read Article 18, Sec. 3, which was recently sent to you via campus mail and is also available on the web at http://www.oaa.pdx.edu/OAADOC/REFDOC/.

October 21, 2002—AAUP/PSU Faculty Senate Shared Governance Conference

PSU-AAUP and the PSU Faculty Senate are co-sponsoring a Shared Governance Conference on Friday, November 15 from 9:30 am to 12:00 pm in the Urban Center Gallery (URBN 2nd floor). Featuring a keynote address by Jane Buck, President of the National AAUP.

Introductory comments by Jennifer Ruth, English. Round-table discussion on the state of shared governance at PSU. Moderated by Gerry Sussman, Urban Studies & Planning. Participants include Charles Heying, Urban Studies & Planning; Provost Mary Kay Tetreault, Office of Academic Affairs; Sherril Gelmon, Public Administration & Presiding Officer of the Faculty Senate; and Duncan Carter, Associate Dean.

Issues addressed will be:

  • The future of tenure
  • The growth of fixed-term ranks and the effect on governance
  • Distance education and higher-education standards
  • The ownership of intellectual property
  • Privatization trends in the university
  • Coporate management styles as the new modus operandi
  • Decision-making at the department level
  • Corporate branding and academic freedom
  • The relationship between faculty senates and collective bargaining

October 4, 2002—The ballots for the ratification of the Article 18 Re-Opener were counted this morning. The membership has voted to ratify the Article 18 Re-Opener, with 98% voting to accept ratification and 2% voting to reject ratification. September 16, 2002—Article 18 Re-opener Informational Forums Scheduled

We have scheduled two Article 18 Re-opener informational forums. These forums have been scheduled so that faculty may come and ask questions about the newly negotiated article prior to returning their ballots. The first form is scheduled for Wednesday, September 18, 1:00-2:00 in SMC 328 and Thursday, September 26, 1:30-2:30 in CH 259. We encourage all faculty to attend!
