Bargaining Updates

We were scheduled to bargain with Admin on June 12th but need to reschedule due to the furloughs. No upcoming date is set but when we do return, we will continue to focus on family and caregiver leave. We are currently struggling to come to agreement on the definition of family to clarify eligibility for expanded leave programs. To help Admin to understand what a 21st century family is, we are asking if members would be willing to review the current definition listed below. If your family doesn’t meet this definition, please consider writing a statement, recording a short video, and/or including photos so we can illustrate the need to update PSU’s definition. We will share these during bargaining with Admin and, if you are comfortable, on social media and member news. Please send to aaup@psuaaup.net. PSU’s defines family member using Federal Family and Medical Leave Act (FMLA) and Oregon Family Leave Act (OFLA) definitions:

FMLA’s definition of a family member is:

  • Spouse

    • FMLA protections do not extend to same or opposite-gender domestic partners.

  • Parent

    • A parent is defined as any individual who had day to day and financial responsibility for you when you were a child. A grandparent, aunt, uncle, etc. could be considered to be your parent.

  • Son/Daughter

    • A son/daughter is defined as any child under 18, or over 18 if incapable of self-care, who is a biological, adopted, or foster child, a stepchild or a legal ward, or a child for whom you are financially responsible and supervise on a day-to-day basis.

OFLA’s definition of a family member is same as FMLA with the following additions:

  • Same-gender domestic partner

  • Same-gender domestic partner's child

  • Same-gender domestic partner's parent

  • Parent-in-law

  • Son/Daughter same as FMLA but includes adult child

  • Grandchild

  • Grandparent
